EverKitten - Terms of Service
1. What EverKitten Is
EverKitten is an online platform that connects prospective cat and kitten owners with independent, verified breeders ("Catteries").
EverKitten is not a seller, breeder, broker, auctioneer, or party to any transaction. We do not own, house, sell, ship, or take possession of any animal. We do not process, hold, or guarantee any payment. All sales, deposits, payments, health guarantees, delivery, and pickup arrangements are made directly between the buyer and the breeder. EverKitten's role is limited to (a) verifying breeders before they may list, and (b) providing tools that help buyers and breeders find and communicate with one another.
By using EverKitten, you acknowledge and agree to this role.
2. Eligibility
You must be at least 18 years old to create an account, list a cattery, or enter into any arrangement through EverKitten.
3. Breeder Verification and Badges
Before a Cattery may list, EverKitten reviews certain information the breeder provides, which may include government identification, a guided video of the cattery, registry membership, and/or a veterinary reference. Badges shown on the platform (for example "Verified cattery," "TICA registered," or "Vet reference confirmed") reflect only that EverKitten completed the specific check described by that badge at the time it was granted.
Badges are not a guarantee. They do not warrant the health, temperament, pedigree, or future condition of any animal, nor the ongoing conduct of any breeder. EverKitten does not certify breeders' ethics, breeding practices, or the outcome of any transaction. Buyers remain responsible for their own due diligence.
4. Breeder Obligations
Catteries that list on EverKitten represent and agree that they will:
- Provide honest, accurate listings and their own photographs and videos of the actual animals offered;
- Comply with all applicable laws, including licensing and animal-welfare requirements;
- Not offer any kitten for homing before it is at least 12 weeks of age;
- State any deposit terms in writing to the buyer before accepting a deposit;
- Provide a live video of an animal on reasonable request;
- Deal honestly and in good faith with buyers.
Catteries are solely responsible for their listings, representations, transactions, and animals.
5. Buyer Acknowledgements
Buyers acknowledge that:
- EverKitten is not a party to and does not guarantee any transaction;
- Payments and deposits are arranged directly with the breeder, and EverKitten never requests or holds payment;
- Buyers should verify each breeder independently, request a live video before paying anything, and obtain all terms in writing;
- Any dispute regarding an animal or transaction is between the buyer and the breeder.
6. Payments
EverKitten does not process, collect, hold, escrow, or refund any payment between buyers and breeders. Any subscription fee EverKitten charges a breeder for use of the platform is separate from, and unrelated to, any transaction between a breeder and a buyer.
6.1 Breeder plans
Breeder plans are billed through Stripe. The monthly plan starts with a free period of 90 days and then renews each month at the price shown at sign-up until cancelled. A breeder may cancel at any time; the plan then runs to the end of the period already paid for. Fees are non-refundable except where the law requires a refund, and except that a breeder whose application EverKitten cannot approve is not charged, or is refunded in full.
6.2 Lifetime plans
From time to time EverKitten may offer a lifetime plan for a single one-time fee. In a lifetime plan, "lifetime" means the lifetime of the EverKitten platform. It does not mean the lifetime of any person, cattery, or business. A lifetime plan gives one cattery access to EverKitten's breeder features for as long as EverKitten continues to operate the platform, and for no longer.
If EverKitten is discontinued, shut down, sold, merged, or otherwise stops offering breeder plans, for any reason and at any time, every lifetime plan ends on that date. Because a lifetime plan has no fixed term and no unused period, no refund, credit, or other compensation is owed when the platform ends, and EverKitten has no further obligation to the breeder under the plan.
A lifetime plan is tied to the cattery it was bought for. It cannot be transferred, sold, or moved to another cattery or account. It remains subject to these Terms and the Seller Agreement in full, including EverKitten's right to suspend or remove a breeder who breaches them, in which case the plan ends without refund. A lifetime plan does not exempt a breeder from verification or from any later change to these Terms.
7. Prohibited Conduct
Users may not: post false, stolen, or misleading content; impersonate others; use the platform to defraud; harass other users; scrape or misuse platform data; or use the platform for any unlawful purpose.
8. Content and Intellectual Property
Breeders retain ownership of the photos and content they upload but grant EverKitten a license to display that content on the platform and to use it in advertising and promotion of EverKitten. The full terms of that license - what it covers, and how to ask us to stop - are in the Breeder Agreement. Users must have the rights to any content they post. EverKitten's own name, logo, and design are its property. Copyright complaints are handled under our DMCA Policy.
9. Disclaimers and Limitation of Liability
EverKitten is provided "as is." To the fullest extent permitted by law, EverKitten disclaims all warranties and is not liable for any dispute, loss, injury, illness, or damages arising from any transaction, animal, breeder, or buyer connected through the platform.
10. Changes
We may update these Terms. Continued use after changes means acceptance of the updated Terms.
