EverKitten - Breeder (Seller) Agreement
Welcome to EverKitten. This agreement explains what we expect from breeders who list on our platform, and what you can expect from us. We've written it in plain English on purpose - you shouldn't need a law degree to understand the rules of the community you're joining.
Who this agreement is between
This agreement is between EverKitten and you, the breeder ("Cattery"). It governs your use of the EverKitten platform. It does not govern the relationship between you and your buyers - that's yours to manage directly, through your own contracts and terms.
What EverKitten is (and isn't)
EverKitten is a marketplace that connects prospective kitten owners with verified home catteries. It's important that you understand our role, because it shapes everything in this agreement:
- EverKitten is not the seller, breeder, or broker of any kitten.
- EverKitten does not process payments, collect deposits, hold funds in escrow, or arrange transportation.
- EverKitten's role is limited to (a) verifying breeders through our published verification process, and (b) allowing approved breeders to advertise their kittens on the platform.
You and your buyers communicate and complete every transaction directly. EverKitten is the introduction and the trust layer - never the middle of the deal.
1. Eligibility
To list on EverKitten, you must:
- be at least 18 years old;
- have the legal right to advertise and place the kittens you list;
- provide truthful, accurate information during verification and afterward.
2. Your Certifications
By joining EverKitten, you certify that:
- all information you submit is truthful and accurate;
- the photos and videos you upload belong to you, or you have permission to use them;
- you are advertising actual kittens that you own or are authorized to place;
- your listings accurately describe each kitten;
- you will disclose known health conditions honestly;
- you comply with all applicable federal, state, and local laws;
- you will update your information promptly if it becomes inaccurate.
3. Verification
Verification is what makes EverKitten different, so we hold it seriously - and so should you.
- A verified badge reflects that you completed EverKitten's verification process at the time it was granted. It is not a guarantee by EverKitten of your kittens, your conduct, or any transaction.
- Verification is not permanent. We may ask you for updated documentation at any time.
- We may suspend or revoke verification if information changes, becomes inaccurate, or if you no longer meet our standards.
4. Listing Standards
When you list on EverKitten, you agree to:
- use only genuine photos and videos of the actual kittens you're offering;
- avoid misleading or exaggerated information;
- represent registration status accurately (including clearly stating when kittens are not registered);
- keep your listings current;
- remove or update kittens promptly once they are no longer available;
- not advertise any kitten younger than 12 weeks old for placement;
- respond to buyer inquiries honestly.
5. Marketplace Conduct
To keep EverKitten a place buyers and breeders can trust, you agree to:
- communicate respectfully with buyers and with us;
- not harass anyone;
- not engage in deceptive practices;
- not manipulate reviews or ratings;
- not impersonate another breeder or cattery;
- not use fake identities or misrepresent who you are.
6. Legal Compliance
You are solely responsible for complying with all laws that apply to you, including those governing breeding, advertising, sales, health documentation, transportation, licensing, taxes, and consumer protection.
EverKitten does not provide legal advice and does not determine whether you comply with the laws that apply to your cattery. Verification confirms the specific things described in our verification process - it is not a certification of legal compliance.
7. Buyer Transactions
To be completely clear about how sales work on EverKitten:
- all sales happen directly between you and the buyer;
- EverKitten is not a party to any transaction;
- EverKitten does not process, collect, hold, or guarantee any payment or deposit;
- EverKitten is not responsible for your contracts, health guarantees, deposit terms, or any dispute between you and a buyer.
We strongly encourage you to use a clear written contract with every buyer. It protects you as much as it protects them.
8. Subscription
- Breeders pay a subscription fee to advertise on EverKitten.
- This fee is for use of the platform only. It is entirely separate from, and unrelated to, any sale between you and a buyer - EverKitten never takes a cut of your kitten sales.
- Subscription fees are non-refundable except where refunds are required by law, and except that if EverKitten cannot approve your application you are not charged, or are refunded in full.
- A lifetime plan, where offered, is a one-time fee for the lifetime of the EverKitten platform, not of any person or cattery. It ends, without refund, if the platform stops operating or stops offering breeder plans, and it is tied to one cattery and cannot be transferred. Section 6.2 of the Terms of Service sets this out in full.
9. Suspension and Removal
We may suspend or remove a cattery from EverKitten for reasons including:
- providing false information;
- posting misleading listings;
- using stolen photos or videos;
- fraud of any kind;
- repeated buyer complaints supported by credible evidence;
- failing to comply with this agreement;
- conduct that damages the trust the marketplace is built on.
When we receive a report, we may investigate and make reasonable decisions to protect buyers and the integrity of the platform. We aim to be fair, and where practical we'll give you a chance to respond - but protecting buyers and marketplace trust comes first.
10. Your Content, and How We Use It
You keep ownership of every photo and video you upload. Nothing here transfers your copyright, and we never claim your kittens as ours.
By posting content to EverKitten, you grant us a non-exclusive, worldwide, royalty-free license to:
- display it on the platform while your listing is active;
- use it to advertise and promote EverKitten - on the site, in our emails, in social posts, in paid advertising, and in press or partner material;
- crop, resize, or shorten it so it fits a particular format, as long as doing so doesn't change what it shows;
- pass it to the advertising and social platforms we run campaigns on, purely so those campaigns can run.
The same permission covers the kitten details that already appear publicly on your listing - name, breed, coat and color, age, and the location shown. Anything you keep private stays private.
Where the format allows it, we'll credit your cattery by name. We will never use your content to suggest that you endorse some other company's product, and we won't present it in a way that misrepresents you or a kitten.
Changing your mind. Email hello@everkitten.com and we'll stop using your content in anything new. What we can't do is un-send what's already out - a campaign already delivered, printed material, a post other people have shared - so this permission continues for anything already distributed. Removing a listing takes it off the platform immediately; on its own it does not pull your content out of a campaign that is already running, though we'll wind that down when you ask.
You must own, or have permission for, everything you post. Copyright complaints are handled under our DMCA Policy.
11. Relationship to Our Other Policies
This agreement works alongside, and is in addition to, EverKitten's Terms of Service, Privacy Policy, and DMCA Policy. If there's a conflict on a breeder-specific matter, this agreement governs.
12. Changes
We may update this agreement from time to time. If we make meaningful changes, we'll let you know, and your continued use of EverKitten after an update means you accept the updated agreement.
